How to Transfer Ownership of a Trademark (Assignment)

According to the Articles 138 and 139 of the Regulations on the Patents, Industrial Designs and Trademarks law (Acted in 2007), any change in the ownership of marks in Iran must be filed with the registration authority. Thus, until the assignment is not registered with the Iran trademark office, this office will only know the person for whom the trademark had been registered. The owner may transfer the ownership of the trademark in part or transfer the whole trademark.

Steps of transferring a trademark

1.      Referring to a notary public in Iran to set up an assignment of trademark document.

2.    The Office's inquiry from the Industrial Property Office to confirm the trademark registration record.

3.      Signing the assignment of trademark agreement by both parties in notary public.

4.     The written request of the owner to register the transfer in the Iran Industrial Property Office together with the valid trademark certificate, assignment of trademark document signed by the previous owner, evidence of legal representation in the presence of an Iranian attorney and payment receipt is provided to the office.

5.      Publishing the assignment in the official gazette.
